Welcome to SharedInformationLedger ("we," "us," or "our"). These Terms & Conditions ("Terms") are applicable when you use our yacht charter services and the website available at sharedinformationledger.xyz (hereinafter referred to as the "Service"), which is provided by SharedInformationLedger.
When you engage in a charter or utilize our Service, you consent to adhere to these Terms. Should you not agree with any section of these Terms, you are prohibited from using the Service.
2. Service Overview
SharedInformationLedger offers a selection of luxury yacht charter services, which include:
- Yacht hire for the day
- Evening yacht excursions
- Executive company outings
- Exclusive gatherings
- Extended trips over several days
These services are subject to both availability and prevailing weather conditions. We retain the authority to change or stop services at our discretion.
3. Booking and Reservations
3.1 Booking Process
Charter reservations require you to:
- Be a minimum of 18 years old
- Supply truthful and thorough details
- Remit the stipulated deposit as indicated in your booking confirmation
- Accept these Terms & Conditions
3.2 Confirmation
Confirmation of your booking is dependent on the payment receipt and our subsequent written confirmation. We reserve the right to decline service to anyone for any reason.
3.3 Availability
Charters are offered based on the availability of vessels and appropriate weather conditions. We will exert every effort to accommodate your requested dates and times.
4. Payment Terms
4.1 Pricing
All listed prices are in € and inclusive of relevant taxes unless stated otherwise. We reserve the right to adjust our prices without prior notice.
4.2 Payment Schedule
- Initial Deposit: 50% of the total charter cost due at the time of reservation
- Remaining Balance: To be paid 48 hours prior to the charter's start
- Additional expenses (if applicable): Payable upon the charter's conclusion
4.3 Payment Methods
We accept the majority of credit cards, electronic bank transfers, and verified cheques. Payments are processed through secure, encrypted platforms.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- With a notice exceeding 72 hours before departure: Complete refund minus service fees
- Notice given between 24 and 72 hours prior to departure: 50% refund
- Less than 24 hours notice prior to departure: No refund provided
5.2 Weather Cancellations
If the captain determines the weather to be unsafe, we propose to:
- Postpone your charter to the nearest available slot without extra charges
- Issue a full refund in case rescheduling is unfeasible
5.3 Equipment Malfunctions
Should there be a mechanical failure with the vessel assigned to you, we will strive to supply an acceptable alternative. If a replacement is not accessible, you will receive a complete return of payment.
6. Safety and Conduct
6.1 Safety Requirements
All guests are required to:
- Adhere to all instructions given by the crew
- Utilize safety equipment as instructed
- Disclose any health conditions that could impact their safety
- Stay within the vessel's designated areas
6.2 Prohibited Items
The following items are forbidden on board:
- Containers made of glass
- Illegal substances
- Firearms or other weapons
- Excessive beverages (beyond a reasonable quantity for personal consumption)
- Animals (except if previously authorized)
6.3 Conduct
Patrons are expected to behave in a courteous and respectful manner. Any passenger behavior that endangers safety or impinges upon other guests' enjoyment may result in the immediate termination of the charter without reimbursement.
7. Liability and Insurance
7.1 Our Liability
We limit our liability to the charter fee paid by you. We are not accountable for:
- Personal injury stemming from passenger carelessness
- Destruction or theft of personal belongings
- Indirect or punitive losses
- Delays due to inclement weather or conditions outside of our control
7.2 Insurance Coverage
We maintain all-encompassing marine insurance that covers our vessels and business operations. Passengers should have their own travel and personal insurance.
7.3 Acknowledgement of Risk
By opting to partake in our charter services, you recognize that marine-based activities carry intrinsic hazards, and you accept responsibility for your safety and security.
8. Modifications and Itinerary Changes
We maintain the right to alter itineraries, paths, or schedules due to atmospheric conditions, safety concerns, or operational imperatives. We will make all possible efforts to offer similar alternative arrangements.
9. Force Majeure
We shall bear no blame for disruptions, terminations, or changes caused by situations beyond our command, including but not limited to:
- Severe climatic conditions
- Catastrophic events
- Rules and regulations set out by authorities
- Port restrictions
- Vessel malfunctions
10. Privacy and Data Protection
The way we manage your personal data aligns with our Privacy Policy. By engaging our services, you give your consent for the collection and application of your data as stipulated in the Privacy Policy.
11. Intellectual Property
All content present on our website, inclusive of text, images, and logos, is safeguarded by copyright and trademark laws. Replication, distribution, or the creation of derivative works is prohibited without our express written consent.
12. Governing Law
These Terms are regulated by the laws in force in Spain. Any disputes shall be settled in the courts present in Barcelona, Spain.
13. Changes to Terms
We reserve the prerogative to adjust these Terms at any stage. Such amendments will be declared on our website along with an updated date of revision. Continued utilization of our services indicates your acceptance of the modified Terms.
